Based on Criminologist Snehil Dhall’s complaint the Mumbai Police has registered FIR against Byju Ravindran u/s 69A of Information Technology Act and 120B of I.P.C for publishing wrong information about United Nations Transnational Organised Crime (UNTOC)
Mumbai: Edtech giant Byju’s to face FIR(Police Case) as Criminologist Snehil Dhall complaint about misquoting UNTOC (India) implementation details which his firm Crimeophobia is implementing through Hon’ble Supreme Court of India (SCI). The Criminology Firm founded by Criminologist Snehil Dhall had filed a Criminal Writ Petition during the year 2016 with the SCI against the Union of India and 45 other ministries for not implementing United Nations Transnational Organised Crime (UNTOC) in the country. Based on the details of UNTOC, there are three key protocols to be followed: Human-Trafficking, Arms & Ammunition Smuggling and Money Laundering. Under this case, the court has already demanded a status report from all the respondents which is in process of being complied. The case also confirms through evidence submitted by Mr. Dhall that the Central Bureau of Investigation (CBI) being the nodal department according to the Central Ministry of Home Affairs isn’t aware of any such responsibilities ordered to them whatsoever. Respective evidence was provided to the Criminologist and these documents were further submitted to the court.
Currently, the issue escalated as companies like Byju’s (Education Tuition Website) were paying SEO money to bring the information of UNTOC at top of the charts on Google as part of the UPSC exam preparations. The key issue is adding onto the sub judice case as other similar online tuition companies were following the trend. However, so far only Byju’s have been found quoting that CBI is the nodal department for implementing UNTOC instead of mentioning Crimeophobia is implementing UNTOC through SCI due to which only Byju’s name has been booked in the FIR filed by Crimeophobia. A legal notice was sent by Crimeophobia to UPSC and Byju’s for not providing accurate information in respect to UNTOC implementation followed by summons from Mumbai Police but the company continued to ignore the issue.
The complaint also states that Byju’s may have an hidden agenda of defaming the nation ahead of India taking over the Presidential post with United Nations Security Council (UNSC) in August 2021 due to which I.P.C section 120b has been added. “The top agenda of India in UNSC is Anti-terrorism and UNTOC is one of the core laws for cutting down terrorism which has no takers for implementation due to which Crimeophobia had taken over the issue through SCI” says Dhall. The fundamental requirement for understanding Human Trafficking aspect along with Arms & Ammunition Smuggling and Money Laundering continues to be a conflict under the UNTOC structure and Byjus is compromising the integrity & sovereignty of India while CBI backed out from being Nodal agency and all States/UTs aren’t aware what needs to be done with UNTOC in their respective jurisdiction. Dhall also mentioned that Crimeophobia is currently receiving intelligence reports from various respondents and wrong information published by Byjus is accounting to misleading, tampering, defaming and influencing a highly sensitive and sub judice case.
The lawyer of Mr. Dhall further confirms the current case status by stating “The complainant Criminologist Snehil Dhall had received a reply from MHA in 2016 that stated Nodal Officers have been received from only twelve States i.e. Goa, Haryana, Jammu & Kashmir, Manipur, Meghalaya, Nagaland, Punjab, Rajasthan, Sikkim, Tripura and West Bengal, and all seven UT’s but this is nowhere close to the implementation proceedings of UNTOC. Furthermore, as of 2021, the Hon’ble Supreme Court of India has received reports of only six respondents against the order passed of the rule being issued” says M.P Sahay, Advocate-on-Record, Supreme Court of India.
Unfortunately, the United Nations seems to have failed in educating the parties about UNTOC for its implementation blueprint, while Indian authorities are still searching takers for its implementation. “The case is of great National Security & Counter-Terrorism importance any information linked to UNTOC cannot be randomly taught or added to the UPSC curriculum which is the elite most entrance exam for creating bureaucrats for the country” says Mr. Dhall. For the longest period, the entire existence of UNTOC was unknown to various government departments until the recent order of the Supreme Court in which the state report has been demanded. Various Government & Corporate bodies have now started uploading information linked to UNTOC (India) on various platforms, whereas, the core information of current status remains solely with Criminologist Snehil Dhall.
Case History: UNTOC was ratified by India under the approval by the then Prime Minister in the year 2002, followed by the President of India signing the same in India in the year 2011 which led to the revised ratification of the same by the Indian Parliament in the same year. Until 2016, a detailed investigation was conducted by Criminologist Snehil Dhall about every aspect of UNTOC (India) implementation and eventually filed a Criminal Writ Petition with the Hon’ble Supreme Court of India as it was found that almost everyone was inactive towards the law. The case was admitted in the year 2017 following subsequent orders being passed for getting the implementation status while CBI denying their responsibilities as the Nodal Department as allotted by the Ministry of Home Affairs. The Covid-19 period has provided additional time to all the respondents for providing their Intelligence Status report to Criminologist Snehil Dhall through the Hon’ble Supreme Court of India.
